TERMS & CONDITIONS OF TRADE
Doogle Inc. Limited T/A BTS Tiling
1.1 'Seller' means Doogle Inc. Limited T/A BTS Tiling, its successors and assigns.
1.2 'Customer' means the person, company or entity requesting Goods or Services.
1.3 'Goods' includes all materials supplied by the Seller.
1.4 'Services' includes all tiling, preparation, installation and related works.
1.5 'Price' means the total amount payable by the Customer.
2.1 The Price shall be as quoted or as invoiced by the Seller.
2.2 Quotes are valid for 30 days and are based on information supplied at time of quoting.
2.3 The Seller may require a deposit prior to scheduling work.
2.4 Payment is due within 7 days of invoice or in accordance with the Construction Contracts Act 2002.
2.5 Tile supply (if applicable) will be invoiced upon delivery and is payable within 7 days.
2.6 The Price may vary if scope, materials or site conditions change.
2.7 Payment must be made via approved electronic methods. Cheques are not accepted.
2.8 Interest at 2.5% per month may be charged on overdue amounts.
3.1 Work is based on standard hours Monday to Friday 8:00am–5:00pm.
3.2 After-hours work will incur additional labour charges.
4.1 Acceptance occurs when a quote is approved, work is instructed, or work commences.
4.2 These Terms become binding upon acceptance.
5.1 The Customer warrants that all surfaces are true, level, plumb and suitable for tiling.
5.2 Any preparation required will be treated as a variation and charged accordingly.
5.3 The Seller will not install tiles on unsuitable substrates including laminated or oil-based surfaces.
6.1 The Seller makes no guarantee regarding underlying structural condition.
6.2 The Seller is not responsible for cracking, movement or failure caused by substrate.
6.3 Builders must correctly install tile underlay over timber flooring.
6.4 The Seller is not responsible for work completed by other trades.
7.1 Pricing is based on standard ceramic or porcelain tiles.
7.2 Alternative tiles including stone, mosaics or large format may require additional charges.
7.3 Tile availability and supply delays are outside the Seller's control.
7.4 Additional materials required will be charged as a variation.
7.5 The Seller is not responsible for defects in Client supplied tiles.
8.1 Heating systems are excluded unless specified.
8.2 Electrical preparation must be completed by others prior to installation.
8.3 Any additional work required will be charged as a variation.
9.1 Risk passes to the Customer upon delivery.
9.2 Ownership remains until full payment is received.
10.1 The Seller may suspend work if payment is overdue.
10.2 All costs associated with recommencement will be payable by the Customer.
11.1 All variations must be approved in writing.
11.2 Variations may impact cost and timelines.
12.1 The Customer must inspect work upon completion.
12.2 Defects must be reported within 7 days.
12.3 Failure to notify constitutes acceptance.
12.4 The Seller may repair or replace defective work.
13.1 A 12-month workmanship warranty applies.
13.2 Warranty excludes movement, misuse and wear and tear.
14.1 Liability is limited to repair or contract value up to $10,000.
14.2 The Seller is not liable for indirect or consequential loss.
15.1 Excludes work by other trades, fixtures and unspecified works.
16.1 The Seller complies with the Privacy Act 2020.
17.1 These Terms are governed by New Zealand law.
